01About this policy

Build Up Capital Pty Ltd (Build Up Capital, we, us) provides property development advisory services. This policy explains how we handle personal information. We handle it in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).

  • Contact details: your name, email address, phone number, business or entity name, and postal address.
  • Enquiry details: what you tell us in our enquiry form, by email or on a call, such as the service you are interested in and where your project is up to.
  • Property and project information: site addresses, title and planning information, plans, quotes, build costs, sale estimates, contracts, loan offers and correspondence with builders, lenders or other parties.
  • Financial and entity information: your borrowing position, funding sources, ownership and trust structures, and ABN, where relevant to a feasibility, finance plan or site bundle.
  • Site bundle information: for buyers, the purchasing entity, contact person, expressions of interest and signed confidentiality agreements. For landowners, ownership and sale details.
  • Billing information: invoicing details and payment records. We do not store full card numbers.
  • Website information: technical data such as your IP address, browser type and the pages you request, collected by our hosting and font providers (see section 07).

Documents you send us may include personal information about other people, such as co-owners, investors, builders or lenders. Please only share it where you are entitled to, and let them know you have shared it with us where appropriate.

Sensitive information. We do not ask for sensitive information, such as health information, racial or ethnic origin, or religious beliefs. If it is needed for a particular reason, we will only collect it with your consent.

03How we collect it

We usually collect personal information directly from you. That happens when you fill in our enquiry form, email or call us, book a session, register for a program, or send us documents.

We may also collect it from third parties where you have asked or agreed. Examples are your lawyer, accountant, mortgage broker, real estate agent, builder or co-investors. We may also use public sources, such as title searches, planning registers and ASIC or ABN records, when we assess a site or a counterparty.

Dealing with us anonymously. You can ask general questions without giving your name, or by using a pseudonym. To give advice on a specific site or project, we will need to know who you are.

04Why we use it

We use personal information to:

  • respond to enquiries and book calls
  • prepare feasibilities, finance plans and other advice, and deliver retainer, support and cohort services
  • run site bundle processes, including qualifying buyers and managing expressions of interest and confidentiality agreements
  • refer you to our panel of lawyers, accountants and other consultants, where you ask us to
  • issue invoices, receive payments and keep business records
  • send you updates about our services, if you have agreed to receive them (see section 08)
  • meet our legal obligations, protect our legal rights, and manage complaints or disputes

We will not use your personal information for an unrelated purpose without your consent, unless the law allows it.

We do not use computer programs to make decisions about you that could significantly affect your rights or interests. Our advice, feasibilities and buyer assessments are prepared and decided by people. We may use software, including spreadsheets and AI-based writing and analysis tools, to help prepare our work, but a person reviews and is responsible for every decision.

We will need to confirm your identity first. We will respond within 30 days. There is no fee to make a request. If giving access involves significant work, we may charge a reasonable cost, and we will tell you before we do.

In limited cases the law allows us to refuse access or correction, for example where it would affect someone else's privacy or a legal dispute. If we refuse, we will explain why in writing and tell you how to complain.

13Complaints

If you think we have mishandled your personal information, please contact us first using the details below. Tell us what happened and how you would like it resolved. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.
